Command control and faster appeals for injured service members
If enacted, your service’s Secretary would keep final say on fitness while you are in disability evaluation. Outside doctors could examine you, but your chain of command would control the process, not the Defense Health Agency. Your commander could pause or pull your case if rules were not followed. You would keep your service’s due‑process rights the whole time. Within 90 days of enactment, DoD would have to add a new appeal. At your request, you could get a full and fair hearing by your Secretary. Your commander must process it. The decision must finish within 90 days from when you start the appeal. If denied, review could go up to the general court‑martial convening authority. This appeal would be in addition to any IDES appeals.
Who counts as a Wounded Warrior
If enacted, the bill would define a “Wounded Warrior” as a service member being processed for medical separation in the disability evaluation system. It would also define “Secretary concerned” and name the Armed Services Committees as the “appropriate congressional committees.” These terms would guide how this section applies.
