Fair and Equal Housing Act of 2025

Sponsored By: Representative Schneider, Bradley Scott [D-IL-10]

Introduced

Summary

Expands 'sex' protections to explicitly include sexual orientation and gender identity. This bill would amend the Fair Housing Act and related language in the Civil Rights Act of 1968 so that references to sex read to include sexual orientation and gender identity, and it would add clear definitions for those terms.

Show full summary
  • LGBTQ people and their households would be able to bring Fair Housing complaints if denied rental, sale, or mortgage services because of sexual orientation or gender identity.
  • Landlords, sellers, brokers, and lenders would be barred from treating people differently in housing transactions based on sexual orientation or gender identity.
  • The bill defines "gender identity" and "sexual orientation" and protects perceived characteristics and associations, making those categories explicit for enforcement under the Fair Housing Act and Section 901 of the Civil Rights Act of 1968.

More housing protections for LGBTQ people

If enacted, the bill would expand Fair Housing Act protections to cover sexual orientation and gender identity. It would add sexual orientation and gender identity wherever the law now says "sex" in several housing rules. It would also add a parenthetical to the Civil Rights Act of 1968 saying "sex" includes sexual orientation and gender identity. The bill would define gender identity to mean gender-related identity, appearance, mannerisms, or other gender traits regardless of sex at birth. It would define sexual orientation as homosexuality, heterosexuality, or bisexuality. The bill would also protect people linked to someone in a protected group and people thought to be in a protected group, even if that belief is wrong.
