In Committee
Summary
Prohibits courts and administrative tribunals in the District of Columbia from deferring to the Mayor's interpretation of statutes or regulations administered by the Mayor or District agencies. This bill would bar any tribunal from granting deference when reviewing an order or decision of the Mayor or an agency and when reviewing a rule adopted by the Mayor or an agency. It would also repeal the Review of Agency Action Clarification Amendment Act of 2025 and restore any law that act amended or repealed as if that 2025 Act had not been enacted.

D.C. courts won't defer to Mayor
If enacted, this bill would stop D.C. courts and administrative tribunals from giving the Mayor or a D.C. agency special deference. Tribunals would not defer to the Mayor's or agency's interpretation of statutes or regulations when they review an order, decision, or rule. The bill would also repeal D.C. Law 26-37 and restore any laws that Act changed. Individuals, businesses, and other parties in D.C. would be able to have agency actions reviewed without forced deference.
