My Body, My Data Act of 2025
Sponsored By: Representative Jacobs, Sara [D-CA-51]
Introduced
Summary
Strong federal privacy protections for personal reproductive or sexual health information would limit what companies collect, keep, use, and share and give people clear rights over that data.
Show full summary
- People would gain robust control over their reproductive and sexual health information, including rights to access, correct, and delete records. Regulated entities must comply with verified requests within 15 days and cannot charge fees.
- Companies covered by the law, including entities under Federal Trade Commission jurisdiction and other businesses engaged in commerce, would have to minimize collection and retention, restrict employee and contractor access, treat service providers as within the compliance perimeter, and publish a binding privacy policy listing third parties and purposes. Information provided to people must be machine-readable to support portability and interoperability.
- Enforcement would be led by the Federal Trade Commission with a private right of action available to individuals, specified remedies and attorney’s fees, and bans on pre-dispute arbitration and class-action waivers. The bill preserves stronger state privacy laws where they already exist.

Bill Overview
Analyzed Economic Effects
4 provisions identified: 4 benefits, 0 costs, 0 mixed.
More control over reproductive health data
This bill would stop covered companies from collecting or sharing your reproductive or sexual health info unless it is strictly needed to give you a product or service you asked for. It would require companies to limit employee and contractor access to only those who need it. You would be able to get, correct, or delete your data, and companies would have to comply within 15 days and not charge you. Companies would also have to post a clear privacy policy naming who they share data with and give direct links to exercise controls. Companies could not retaliate against you for using these rights.
You can sue over reproductive data
You would be able to sue if a covered company violates this bill. If you win, a court could award at least $100 and up to $1,000 for each violation for each day it happened, or actual damages, whichever is larger. Courts could also award punitive damages and reasonable attorney fees. The bill says a violation of reproductive or sexual health data counts as a real injury for standing.
States can keep stronger privacy laws
This bill would not override state laws that give stronger privacy protection. States could keep rules that are stricter than the federal standard. The bill also preserves other federal laws except where this Act specifically provides otherwise.
Stronger enforcement and court access
This bill would let the Federal Trade Commission enforce these rules as unfair or deceptive acts. The FTC could issue implementing rules using the normal rulemaking process. The bill would also make pre-dispute arbitration agreements and class-waivers invalid for disputes under this bill. A court, not an arbitrator, would decide whether arbitration rules apply.
