Propane Accessibility and Regulatory Relief Act
Sponsored By: Representative Burlison, Eric [R-MO-7]
In Committee
Summary
Exempts propane tanks with capacity up to 126,000 pounds from the Chemical Facility Anti-Terrorism Standards (CFATS). This bill would direct the Secretary of Homeland Security to take the actions needed to remove CFATS coverage for any propane tank that holds up to 126,000 pounds of propane. The exemption is defined by the pounds-based capacity threshold and is tied to the CFATS regulatory framework in section 2101 of the Homeland Security Act of 2002 (6 U.S.C. 621). Owners and operators of tanks that meet the limit would no longer be subject to CFATS requirements.

Fewer federal rules for propane tank owners
If enacted, owners and operators of propane tanks that hold up to 126,000 pounds of propane would be exempt from CFATS rules. The bill would direct the Secretary of Homeland Security to take any actions needed to carry out that exemption. This would remove federal CFATS security requirements for qualifying tanks and could lower regulatory costs for those businesses. It could also reduce federal security oversight and might affect local safety.
