Bill Overview
Analyzed Economic Effects
2 provisions identified: 2 benefits, 0 costs, 0 mixed.
Protect DHS detention oversight offices
This bill would prohibit the Secretary of Homeland Security, subject to the availability of appropriations, from discontinuing or reducing the Office of the Immigration Detention Ombudsman or the Office for Civil Rights and Civil Liberties. The rule would keep those two DHS oversight offices operating to support detainee oversight and civil-rights review, effective upon enactment.
Public online ICE detention database
This bill would require the Secretary of Homeland Security to create a public online database, maintained by DHS, about people in ICE custody and ICE detention sites. For each person the database would report the legal authority for detention, how long they have been detained, detention location (except for minors, people under a protection order, or witness-protection participants), transfers and number of transfers, and whether a removal order exists. The database would publish aggregate detainee demographics (nationality, age, and immigration status), disciplinary actions and uses of force, and deportation records. For any non-traditional detention site the database would include type and specific location, a justification, bed count, compliance efforts, a standard of care including medical access, a timeline with estimated costs and budget, and any agreements or payment records. The database would list open or unresolved DHS and GAO recommendations with ICE's timeline or rationale for not adopting them. The database would be updated daily, archive prior-day information for annual public access, and would not include any personally identifiable information.
