Preventing Authoritarian Policing Tactics on America’s Streets Act

Sponsored By: Representative Bonamici, Suzanne [D-OR-1]

Introduced

Summary

Limits federal crowd-control authority while forcing visible officer identification and public reporting. This bill would curb when and how federal law enforcement and armed forces may be used for crowd control in the United States and raise transparency for deployments.

Show full summary
  • Families and the public would see fewer federal crowd-control operations off federal property because crowd-control powers are limited to federal property and its immediate adjacent sidewalks and streets except for a joint written state and local request or an invocation of the Insurrection Act.
  • Federal officers and armed forces would have to display their agency and last name or a unique identifier at all times and may not mask that ID or use unmarked vehicles. Contractor and subcontractor personnel who perform law enforcement duties are treated the same.
  • State and local leaders gain a clear path to request federal help through a joint written request from the Governor and the head of local government.
  • People detained during deployments gain faster transparency because the deploying agency or force must publish, within 24 hours, the deployment date, number of personnel in each locality, mission description, where detainees are held, and any written request for assistance.

Bill Overview

Analyzed Economic Effects

3 provisions identified: 2 benefits, 0 costs, 1 mixed.

Clear ID and public notice for protests

If enacted, federal officers and military members at protests would need visible ID that shows their agency and name or a unique ID. Military members would also show rank. They could not cover that ID or use unmarked vehicles to detain or arrest people during those actions. Within 24 hours of any deployment, the agency would post the date, headcount by city, mission, where detainees are held and by whom, and any written state or local request for help. Arrests would be unlawful if an officer violates these ID rules or the bill’s location limits.

Limits on federal protest policing off federal land

The bill would limit federal crowd-control and arrest powers to federal property and the sidewalk or street right next to it. This limit would not apply if a state governor and the local government head jointly request help in writing, or if the Insurrection Act is invoked.

Who counts as a federal officer here

The bill would define who is covered by these protest rules. It would include federal employees and contractors who do law enforcement work. It defines law enforcement work to include prevention, detection, investigation, prosecution, and incarceration. It would use existing legal definitions for members of the Armed Forces and National Guard.
