Show full summary
  • Foreign individuals and entities could face asset-blocking measures and immigration penalties, including immediate visa revocation and ineligibility for admission under the Immigration and Nationality Act.
  • The President would be authorized to prohibit all transactions in property in the United States, property that enters the United States, or property controlled by a U.S. person, using authority under the International Emergency Economic Powers Act.
  • Humanitarian trade and assistance are exempted, including sales of food, medicine, medical devices, and transport needed for humanitarian operations, and sanctions would not apply to those seeking to reestablish Ukrainian operational control of the plant or surrounding region.
  • The President may waive the sanctions if he certifies to the House Committee on Foreign Affairs and the Senate Committee on Foreign Relations at least 15 days before the waiver that it is vital to U.S. national security.

Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 1 costs, 1 mixed.

Humanitarian and UN carveouts to sanctions

If enacted, sanctions would not block humanitarian work. Food, medicine, medical devices, aid operations, related payments, and needed transport could continue. Admission limits would not apply when needed to meet U.N. Headquarters or other treaty duties. Sanctions would also not cover foreign persons working to restore Ukrainian control of the Zaporizhzhia plant and nearby area.

Block assets and visas for plant violators

If enacted, the President could block all U.S.-linked property of foreign persons who endangered the Zaporizhzhia nuclear plant or undermined Ukraine’s control since Russia’s full-scale invasion. The block would cover property in the United States or held by U.S. persons. These noncitizens would be denied visas and admission to the United States. Any visas already issued would be revoked right away and would automatically cancel other valid entry papers.

Enforcement powers and national-security waiver

If enacted, the President could use IEEPA powers to issue rules and orders to enforce these sanctions. IEEPA civil and criminal penalties would apply to violations or attempts to violate the rules. The President could waive sanctions for a foreign person if it is vital to U.S. national security and Congress is notified at least 15 days before.
