Show full summary
- Nonmilitary overseas voters must provide a verifiable mailing address within the State that shows either their current residence or the current residence of a spouse, parent, or legal guardian to receive a State absentee ballot.
- The Presidential designee may not send a Federal write-in absentee ballot unless the voter provides the same verifiable in-state mailing address. This requirement does not apply to absent uniformed services voters.
- If an overseas voter fails to provide the required information for a regularly scheduled general election for Federal office in the State where they seek to vote, they may vote in the District of Columbia on the same date and will be considered a D.C. resident for that election. The rule applies to elections held in 2026 and later.

Overseas ballots need proof, DC backup
If enacted, non‑military overseas voters would need to give a verifiable in‑state mailing address to get an absentee ballot. The address must show the voter’s current residence, or that of a spouse, parent, or legal guardian. States and the Presidential designee would not send state absentee or Federal write‑in ballots without this proof. If a voter cannot provide it for a regular Federal general election, they could instead vote in the District of Columbia’s regular Federal general election on the same date and be treated as a DC resident for that election. This would apply to elections held in 2026 and later, and it would not apply to absent uniformed services voters.
