Safe Transit Accountability Act
Sponsored By: Representative Smucker, Lloyd [R-PA-11]
In Committee
Summary
This bill would give a final decisionmaker role for the accountable executive over Safety Committee disputes and recommended risk-based safety mitigations. It would add a new subparagraph to 49 U.S.C. 5329(d)(5) so the accountable executive becomes the sole tiebreaker when a transit agency's Safety Committee cannot agree and decides whether to implement risk-based mitigations or strategies. The bill defines the accountable executive as the single person with ultimate responsibility for the Public Transportation Agency Safety Plan, responsibility for the Transit Asset Management Plan, and control over the resources needed to carry out both plans.

Transit chief gets final safety say
If enacted, transit agencies would have one "accountable executive" make final safety decisions. That person runs the agency’s Safety Plan and Asset Management Plan and directs people and capital to run both. The executive would decide whether to use risk-based fixes the Safety Committee recommends. They would also be the sole tiebreaker in Safety Committee disputes. The change would start upon enactment and adds no new funding.
