Saving the Civil Service Act

Sponsored By: Representative Connolly, Gerald E. [D-VA-11]

Introduced

Summary

Protecting the competitive civil service by banning the creation of Schedule F and limiting the expansion of noncompetitive job schedules. It would require written employee consent for many transfers and cap moves from the competitive service into the excepted service during each presidential term.

Show full summary
  • Federal employees: Competitive service employees could not be moved into the excepted service without their prior written consent.
  • Agencies: Agencies could place positions only into schedules A through E as defined in the Code of Federal Regulations on September 30, 2020. An agency could transfer at most 1 percent of its workforce or five employees, whichever is greater, into the excepted service during a four-year presidential term. Agencies would also need the Director of the Office of Personnel Management's prior consent to move occupied positions into schedule C.
  • Office of Personnel Management and Department of Veterans Affairs roles: The Director of the Office of Personnel Management would be required to issue regulations to implement these limits. The restrictions would apply to positions under chapters 73 and 74 of title 38, covering certain Department of Veterans Affairs jobs.

Limits on federal employee transfers

This bill would stop agencies from creating Schedule F and limit moves out of the competitive service. During any four‑year presidential term, an agency could move at most the greater of 1% of its staff or five employees from the competitive into the excepted service. You could not be moved from the competitive service into the excepted service without your prior written consent. An excepted‑service employee could not be moved to a different excepted schedule without written consent. Agencies could not move occupied jobs into Schedule C without the prior consent of the OPM Director. Competitive‑service positions could only be excepted into schedules A through E and must follow part 6 rules as of Sept. 30, 2020. The OPM Director would have to issue rules to implement these limits, and the limits would apply to VA positions under chapters 73 and 74 of title 38.
