Parents Opt-in Protection Act
Sponsored By: Representative Miller, Mary E. [R-IL-15]
In Committee
Summary
Requires explicit, per-survey written opt-in consent before any school survey, analysis, or evaluation that reveals personal information. It would tie consent to each specific survey and assign consent to the student if the student is an adult or emancipated, or to the parent for unemancipated minors.
Show full summary
- Families and parents: Parents of unemancipated minors would have to give written permission for each individual survey that asks about a student or the student’s family. This shifts control to parents for those students.
- Students: Adults and emancipated minors would need to provide written consent for each specific survey that collects personal information about them or their family.
- Schools and program administrators: School officials and evaluators would be required to obtain separate written consent for each survey, analysis, or evaluation instead of relying on blanket or general consent. The bill amends Section 445 of the General Education Provisions Act (20 U.S.C. 1232h) to codify this per-survey opt-in framework.
