AUKUS Improvement Act of 2025

Sponsored By: Representative Amo, Gabe [D-RI-1]

Introduced

Summary

Makes it easier for the U.S., Australia, and the U.K. to move defense gear and know-how among themselves. The AUKUS Improvement Act of 2025 would change the Arms Export Control Act so certain defense articles can be reexported, retransferred, or temporarily imported exclusively between the three governments and eligible entities without requiring presidential consent, and it would remove a certification step for some commercial technical assistance and manufacturing license agreements with Australia and the United Kingdom.

  • Governments and allied operations: Allows defense items sold under the Arms Export Control Act to be reexported and retransferred between the U.S., Australia, and the U.K. without the President's consent under certain statutes, smoothing AUKUS logistics.
  • Defense companies and contractors: Eliminates the certification requirement for commercial technical assistance and manufacturing license agreements involving Australia and the United Kingdom, reducing regulatory steps for cross-border defense contracts.
  • Personnel and multinational units: Authorizes intra-company, intra-organizational, and intra-governmental transfers and services among authorized officers, employees, and agents, including dual or third-country nationals who meet specified regulations, easing movement of parts and personnel for joint projects.

Easier defense transfers with Australia and United Kingdom

If enacted, defense companies and their workers would face fewer U.S. approvals for work with Australia and the United Kingdom. U.S. government–sold defense items could be reexported, retransferred, or temporarily imported only between Australia and the United Kingdom or eligible entities, without Presidential consent. The bill would drop a certification step for technical assistance or manufacturing license agreements for or in Australia or the United Kingdom; NATO members (not including the United Kingdom) and Japan would keep the existing rule. Intra-company and government transfers would be allowed among officers, employees, and agents who meet 22 C.F.R. 120.64; dual or third‑country nationals must meet 22 C.F.R. 126.18. These changes would take effect upon enactment.
