Stop Greenlighting Driver Licenses for Illegal Immigrants Act
Sponsored By: Representative Arrington, Jodey C. [R-TX-19]
Introduced
Summary
Tie federal Byrne JAG grants to state driver license and immigration-data policies. This bill would condition Edward Byrne Memorial Justice Assistance Grant Program funds on whether a state issues driver licenses without proof of U.S. citizenship or lawful presence and on whether the state permits sharing immigration enforcement information with DHS.
Show full summary
- States that issue driver licenses to people lacking proof of citizenship or lawful presence would have to return unobligated Byrne JAG funds within 30 days after such a license is issued and would be ineligible for future Byrne JAG grants until they change their laws.
- Units of local government that receive Byrne JAG grants directly are included in the funding restrictions and could lose or be barred from future grants if their state is noncompliant.
- Immigrants without proof of U.S. citizenship or lawful presence would face stronger incentives for states to stop issuing them driver licenses to avoid funding penalties.
- The bill requires states to allow collection and sharing of "immigration enforcement information" with DHS. That term covers citizenship or immigration status and the date, time, and location of releases from detention, jail, or prison.

Justice grants tied to licenses and info
This bill would tie state justice grants to two rules. If a state gives a driver license to someone without proof of citizenship or lawful presence, it would have to return any unused (unobligated) Byrne JAG money within 30 days of issuing that license. If a state blocks sharing immigration enforcement information with DHS, it would have to return any unused (unobligated) Byrne JAG money within 30 days after enactment. The state would be ineligible for new Byrne JAG grants until it both bans those licenses and allows collecting and sharing that immigration information with DHS.
Defines covered grants and information
If enacted, the bill would define what grants and data these rules cover. Byrne JAG funds would include state awards and grants paid directly to local governments. Immigration enforcement information would include a person’s citizenship or immigration status, and the date, time, and place of release from jail or prison. The bill would use the existing federal meaning of "State." These definitions would guide which grants must be returned and what information states must allow to be shared.
