Sponsored By: Representative Cohen, Steve [D-TN-9]

In Committee

Summary

Expands access to SNAP and state TANF-funded assistance for people with drug convictions and those nearing reentry. The bill aligns federal definitions and blocks state rules that deny SNAP based on controlled-substance convictions, and it counts people scheduled for release within 30 days as part of a SNAP household.

Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 1 costs, 0 mixed.

SNAP access for people with convictions

If enacted, the bill would stop States from using drug convictions to deny SNAP benefits. Any State law or policy that denies SNAP eligibility for a controlled-substance conviction would have no force or effect. It would also let incarcerated people scheduled for release within 30 days count in a SNAP household for eligibility and benefit calculations. Together, these changes would expand SNAP access for low-income people with convictions and people nearing reentry.

Drug convictions and TANF coverage

If enacted, this would change which State TANF-funded programs a federal drug-conviction rule covers. The bill would amend Section 115 so it applies to assistance under any State program funded under part A of title IV (42 U.S.C. 601 et seq.). It would also define “State” by reference to section 419 of the Social Security Act (42 U.S.C. 619). These changes could affect whether a drug conviction changes eligibility for cash assistance under State TANF programs.
