Deceptive Downsizing Prohibition Act of 2025

Sponsored By: Representative Correa, J. Luis [D-CA-46]

Introduced

Summary

Prohibits deceptive downsizing of consumer products and forces clear labeling when makers shrink items without changing the packaging. The bill would direct the Federal Trade Commission to write rules banning the sale of a reduced-size product in the same or substantially similar packaging as a prior larger version, define terms like “reduced size” and “larger size”, and allow a safe harbor only when a conspicuous notice on the principal display panel states both the prior larger size and the new reduced size.

Bill Overview

Analyzed Economic Effects

2 provisions identified: 2 benefits, 0 costs, 0 mixed.

Clear notice when packages shrink

This bill would ban “deceptive downsizing” by manufacturers. If they sell a smaller amount in the same or similar package, they would need a front‑label notice. The notice would be on the principal display panel. It would have to be clear, easy to read, and show both the old larger size and the new smaller size. This could help shoppers spot size changes before buying.

FTC rules to police downsizing

The FTC would be able to issue rules to carry out this bill. Violations would count as unfair or deceptive acts under the FTC Act. The FTC would enforce using its existing powers and penalties. Nothing in this bill would limit other FTC authority.
