Faster local approvals for 5G upgrades
If enacted, local and state governments, and their instrumentalities, would have 60 days to act on eligible requests to modify existing wireless equipment. If they do not approve or send a written decision with reasons and legal citations within 60 days, the request would be approved the next day. The 60-day clock could pause only if a written missing-info notice is sent within 30 days of the first filing, and for later filings within 10 days. The clock could also pause if both sides agree. A request would count as submitted when the company takes the first procedural step it controls. Governments could not require pre-application meetings and could ask only for information tied to eligibility that is in a public rule. Companies could sue in U.S. district court for expedited review. These rules would apply to eligible requests filed on or after enactment.
FCC rules due in 180 days
If enacted, the FCC would have 180 days after enactment to issue final rules to carry out these changes. This is a deadline on the agency and could speed implementation. It would not, by itself, create new payments, fees, or taxes.
