Broadband Competition and Efficient Deployment Act

Sponsored By: Representative Joyce, John [R-PA-13]

Introduced

Summary

Exempts certain telecom collocations from federal environmental and historic-preservation review. This bill would say a Federal authorization for a "covered project" is not a major Federal action under the National Environmental Policy Act and that a covered project is not an "undertaking" under the National Historic Preservation Act.

Faster telecom upgrades on existing infrastructure

If enacted, some telecom projects on existing poles, towers, or buildings would skip key federal reviews. Covered projects would not trigger NEPA major‑action review or the Historic Preservation Act Section 106 process. This would apply to projects that place, build, or modify a telecom facility on eligible support infrastructure. The infrastructure must already support, or be able to support, wire communications when a complete local or Tribal request is filed. A project would also need an FCC permit or be under FCC jurisdiction. This could speed upgrades, but reduce environmental and historic consultation, including with Tribal governments.
