Introduced
Summary
Preempts State and local enforcement of International Criminal Court (ICC) requests without express federal authorization.
Show full summary
- Foreign nationals: State and local officers would be barred from arresting, detaining, or otherwise depriving the liberty of a foreign national solely because of an ICC indictment, warrant, summons, or request.
- State and local law enforcement: The bill would forbid cooperation with the ICC to effectuate arrests and would bar use of local funds, facilities, personnel, or equipment for that purpose.
- Federal exceptions and legal effect: Congress could enact case-specific authorization and the President could issue a written certification and authorization for national security cases. The act would override any state or local law that permits inconsistent actions and includes a severability clause so other provisions remain if one is struck down.

Bill Overview
Analyzed Economic Effects
3 provisions identified: 2 benefits, 0 costs, 1 mixed.
States barred from ICC arrests or help
If enacted, state and local officers would be barred from arresting or detaining a foreign national based only on an International Criminal Court warrant, indictment, or summons. They would not be able to help the Court or use state or local money, staff, or equipment for those arrests. The Act would override any state or local rule that conflicts with these limits. This would take effect upon enactment.
Limited federal exceptions for ICC help
If enacted, there would be two narrow exceptions. Congress could pass a law to allow help in a specific case. Or the President could certify it is essential to a declared national security interest and give written authorization. These exceptions would only apply under those conditions and would take effect upon enactment.
Court loss would not end the Act
If enacted, if a court strikes down part of the Act, the rest would still apply to other people and situations. One loss would not cancel the entire Act. This would take effect upon enactment.
