For the relief of Blanca Martinez.
Sponsored By: Representative Moulton, Seth [D-MA-6]
Introduced
Summary
Creates a path to lawful permanent residence for Blanca Martinez. The bill would let her apply for an immigrant visa under section 204 or seek adjustment of status under section 245 even if normally ineligible. If she entered the United States before the filing deadline she would be treated as having entered and remained lawfully and could adjust status as of enactment. It would bar removal or denial for grounds shown in Department of Homeland Security or State Department records and require rescinding any such orders. Applicants must file with appropriate fees within 2 years. If she receives a visa or green card the State Department must reduce her birth-country visa total by one and her natural parents, brothers, and sisters would not receive immigration preference solely because of their relationship to her.

Permanent resident relief for Blanca Martinez
If enacted, this bill would let Blanca Martinez apply for an immigrant visa or a green card even if standard limits would block it. She would need to file and pay the application fees within 2 years after enactment. If she entered the U.S. before that deadline, she would be treated as having entered and stayed lawfully as of enactment. She could then seek to adjust status if she otherwise qualifies. She could not be removed or denied admission based on grounds listed in DHS or State Visa Office records as of enactment. DHS would need to cancel any covered removal, deportation, or inadmissibility orders against her. If her visa or green card is granted, State would reduce by one the visa count for her birth country in that year or the next.
No immigration benefits for Blanca's parents or siblings
If enacted, Blanca Martinez’s natural parents, brothers, and sisters would not get immigration rights or status just because they are related to her. They would need to qualify on their own under normal rules.
