Show full summary
- FAA staff and programs — Programs, projects, and activities that were funded in the preceding fiscal year may continue using Trust Fund amounts that are not otherwise appropriated. Funding for any program cannot exceed the rate provided in the prior year and begins on the first day of a lapse.
- Airports and infrastructure — Airport grants and capital projects that received prior‑year funding can keep receiving eligible Trust Fund support under the same limits and conditions for up to 30 days or until a regular appropriation or continuing resolution becomes law.
- Budget accounting and legal limits — Funds remain subject to the preceding year’s terms and conditions and any expenditures will be charged to the applicable appropriation when a regular appropriation or joint resolution becomes law. The bill also amends the Internal Revenue Code expenditure authority to reference this Act.

Backup funding to keep FAA running
If enacted, the FAA could use the Airport and Airway Trust Fund to keep working during a funding lapse. It would cover FAA Operations, Facilities and Equipment, Research, Engineering, and Development, and Grants-in-Aid for Airports, including loan and loan guarantee costs. Funding would start on day one of a lapse and end when a new appropriation or a continuing resolution becomes law, or after 30 days, whichever comes first. Spending would be limited to last year’s rates and terms; if last year had only a continuing resolution, that rate would apply. If a lapse crosses into a new fiscal year, the same temporary levels would continue. This would not apply where another law already funds or blocks the activity. A technical change would also add this Act to the trust fund’s allowed uses so Treasury can make these payments.
