Bill Overview
Analyzed Economic Effects
3 provisions identified: 0 benefits, 2 costs, 1 mixed.
Ban on importing mifepristone by mail
If enacted, no one would be allowed to import mifepristone into the United States. The ban would include mailing the drug to individuals. It would apply despite other laws and would start at enactment.
Return to 2011 safety rules for mifepristone
If enacted, HHS would bring back the 2011 safety rules for mifepristone. The Secretary would withdraw the current rules and approve the 2011 rules within 90 days. Starting at enactment, HHS could not approve any different rules. The bill also says the “covered medication” is mifepristone (brand names Mifeprex and Korlym; code name RU-486).
Right to sue over illegal mifepristone
If enacted, you could sue if you were hurt by mifepristone that was imported or moved illegally. You could sue telehealth providers, pharmacies, or others who knowingly moved the drug in violation of 18 U.S.C. 1462. You could seek compensatory and punitive damages and attorney’s fees in federal or state court. This would start 90 days after enactment. State remedies would still apply.
