BLOOD Centers Act
Sponsored By: Representative Wied, Tony [R-WI-8]
Introduced
Summary
Creates an expedited federal approval path for blood centers to add apheresis collection devices to existing biologics licenses (supplemental biologics license applications or BLAs). It would require the Health and Human Services Secretary to set that process within 180 days and to approve qualifying supplemental BLAs within 30 days unless there are specific safety, purity, potency, or systemic compliance concerns, and it would limit eligibility to operators who hold at least one biologics license and who either have licenses at three or more FDA-registered locations or are accredited and in good standing by an accreditation organization whose standards meet or exceed applicable regulatory requirements.

Faster FDA approvals for blood centers
If enacted, the bill would require the HHS Secretary, through the FDA, to set up an expedited approval process within 180 days. Under that process, qualifying supplemental biologics license applications to add an apheresis device at a new location would have to be approved within 30 days after submission. To qualify, the applicant must hold a biologics license for at least one blood center site and either have that license at 3 or more FDA-registered locations or be accredited and in good standing by an accreditation organization with standards that meet or exceed applicable regulatory requirements, as determined by the Secretary. The FDA could deny or delay approval only if it finds a specific safety, purity, or potency concern at the new location or a systemic failure by the owner or operator to meet safety standards at other licensed locations.
