Sponsored By: Representative Barr, Andy [R-KY-6]

In Committee

Summary

Centralize permitting classification and dashboard visibility for DPA-backed critical minerals projects. This bill would treat certain Defense Production Act section 303 actions under Presidential Determination 2022-11 as covered projects for the FAST Act and require their inclusion on the Permitting Dashboard, while allowing project sponsors to opt out.

Permits for Defense-backed critical minerals

This bill would treat actions the Secretary of Defense takes under Presidential Determination 2022-11 as covered projects under the FAST Act. Those projects would be listed on the federal Permitting Dashboard. Covered actions would include feasibility studies for mature mining and processing, by-product and co-product production at existing mines and mine reclamation sites, and modernization to raise productivity, environmental sustainability, or worker safety. Any other activity authorized under section 303(a)(1) of the Defense Production Act would also qualify. A project sponsor could ask that an action not be treated as a covered project and not be listed. These rules would take effect upon enactment.
