  • Forest Service plans: Would amend 16 U.S.C. 1604(d)(2) so the Secretary would not be required to reinitiate consultation under section 7(a)(2) of the Endangered Species Act for land management plans that are approved, amended, or revised when a new species is listed or critical habitat is designated, or when new information reveals effects not previously considered.
  • Bureau of Land Management plans: Would add subsection (g) to 43 U.S.C. 1712 to bar additional ESA consultations or CFR 402.16 reviews on land use plans approved, amended, or revised when a new species is listed or new information shows previously unconsidered effects.
  • Scope and override: The bill targets plans approved, amended, or revised under the cited statutes and says the restriction applies notwithstanding any other provision of law, creating a statutory bar to reinitiation under the described triggers.

Fewer Endangered Species reviews for land plans

If enacted, this bill would limit when the Forest Service and the Bureau of Land Management must restart Endangered Species Act consultations on their land management or land use plans. They would not need to reinitiate consultation when a new species is listed or new critical habitat is designated. They also would not need to restart consultation if new information shows different effects on listed species or critical habitat. This could reduce plan-related delays for permittees and businesses on those lands. It could also reduce updates that protect newly listed species and habitats. It would take effect upon enactment.
