END Illicit Chinese Tobacco Act
Sponsored By: Representative Van Duyne, Beth [R-TX-24]
Introduced
Summary
Authorizes destruction of counterfeit, adulterated, or misbranded tobacco products offered for import. It would amend the Federal Food, Drug, and Cosmetic Act to add "counterfeit tobacco product" (as defined in section 900) into the statute's counterfeit-device language and to replace references to "drug or device" with "drug, device, or tobacco product" so imported tobacco can be destroyed. The changes would apply beginning on the date of enactment.

FDA could destroy unsafe tobacco imports
This bill would let the FDA destroy adulterated, misbranded, or counterfeit tobacco products at the border. It would treat tobacco like drugs and devices for removal when offered for import. The change would start on the date the bill becomes law. Importers and distributors would face the same destruction rules used for unsafe drugs. Consumers would be less likely to see unsafe imported tobacco.
