No Payola Act

Sponsored By: Representative Leger Fernandez, Teresa [D-NM-3]

Introduced

Summary

Repeals the private right of action and related Senate notification rules for legal process on Senate data and requires Senators to disgorge awards they received under that mechanism.

Show full summary

The disgorgement applies to awards made between the enactment of Public Law 119-37 and the enactment of this Act.

  • Senators: Any Senator who was awarded funds under the private right of action during the covered period would have to pay those awards into the Treasury's general fund.
  • Plaintiffs and litigants: Individuals or groups that used the private right of action to seek Senate data would lose that legal route going forward.
  • Senate data handling: The repeal removes the notification requirements tied to legal process over Senate data, changing how disclosures are handled.

Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 1 costs, 0 mixed.

Claw back lawsuit awards from Senators

If enacted, any Senator who received money from a lawsuit under the 2026 Senate data rule would have to pay it back. The payback would cover awards made from the day Public Law 119-37 took effect until this act takes effect. The amount due would equal the award and would be paid to the U.S. Treasury. This would apply despite any other law and would take effect upon enactment.

Repeal Senate data disclosure rules

If enacted, this would repeal the 2026 rules on disclosures of Senate data. Senators and Senate offices would no longer have to follow the notice and disclosure requirements added by that law. It would also end the private right to sue under those rules. These changes would take effect upon enactment and would not change household taxes or benefits.
