For the relief of Maria Merida de Macario.
Sponsored By: Representative Moulton, Seth [D-MA-6]
Introduced
Summary
Grants lawful permanent resident status to Maria Merida de Macario. The bill would allow her to be issued an immigrant visa or to adjust status notwithstanding numerical limits in the Immigration and Nationality Act, provided she files an application under section 204 or section 245 with required fees within two years of enactment. It would waive any grounds for removal or inadmissibility reflected in Department of Homeland Security or State Department records and require rescission of any existing removal orders or findings against her. If she entered before the filing deadline the bill would treat that entry as lawful for adjustment eligibility as of the date of enactment. On approval, the Secretary of State must reduce the visa allocation for natives of her country of birth by one in the current or next fiscal year. The bill also prevents her natural parents, brothers, and sisters from receiving immigration rights or benefits based on their relationship to her.

Green card path for Maria Merida de Macario
If enacted, Maria Merida de Macario could apply for an immigrant visa or ask to become a lawful permanent resident. She would need to file the application and pay the fees within 2 years of enactment. If she enters the U.S. before that deadline, she would be treated as having entered and stayed lawfully and could be eligible to adjust status as of enactment, if otherwise eligible. DHS would have to cancel any removal or deportation orders and any inadmissibility or deportability findings recorded against her on the enactment date. DHS and the State Department could not remove her or deny her admission based on those recorded grounds.
No status benefits for her relatives
If enacted, Maria Merida de Macario’s natural parents, brothers, and sisters would not get immigration rights just because they are related to her. They would gain no status or privileges from that family tie alone.
One fewer visa for her country
If enacted, when Maria Merida de Macario is granted a visa or permanent residence, the State Department would cut her birth country’s visa count by 1. The reduction would occur in the current or next fiscal year.
