CLOSE Act

Sponsored By: Representative Clarke, Yvette D. [D-NY-9]

Introduced

Summary

Ends the oil and gas aggregation exemption in the Clean Air Act and brings hydrogen sulfide into the hazardous air pollutant framework. This bill would make it harder for operators to combine small emission sources to avoid HAP rules and would require the EPA to list hydrogen sulfide and set source categories, including oil and gas wells.

Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 0 costs, 1 mixed.

List hydrogen sulfide as hazardous pollutant

The EPA would have to add hydrogen sulfide to the hazardous air pollutant list within 180 days of enactment. Within 1 year after that rule, EPA would have to name source categories, including oil and gas wells. This could lead to new emission standards and controls. Communities near emitters could see lower exposure, while operators could face new compliance costs.

Close oil and gas emissions loophole

This bill would remove a Clean Air Act exemption for oil and gas sites. Today, some sites can pool emissions to avoid stricter toxic air rules. The exemption would end upon enactment. More facilities could face hazardous air pollutant limits and controls. Nearby communities could gain health protections, while operators could face higher compliance costs that might affect prices.
