  • Nationals who live in a State or in a territory covered by Immigration and Nationality Act sections 301–308 could, by written request on their application, receive a passport identifying them as both a U.S. national and a U.S. citizen.
  • The Secretary of State would review proof of national status and issue passports, and the bill would amend the Immigration and Nationality Act text and repeal Section 325 to reflect the new passport procedure.

Passports and elective citizenship for U.S. nationals

If enacted, non‑citizen U.S. nationals (including many born in American Samoa) could apply for a U.S. passport. If the State Department is satisfied you are a national, it would issue a passport that says “U.S. national, not a citizen.” If you live in a State or in a territory subject to sections 301–308 and ask in writing, your passport could instead show you as a U.S. citizen. This would take effect upon enactment. The bill would also repeal Section 325 of the Immigration and Nationality Act.
