No Surrogacy for Sex Offenders Act
Sponsored By: Representative Luna, Anna Paulina [R-FL-13]
Introduced
Summary
Bars registered sex offenders from using interstate or foreign commerce to enter surrogacy arrangements with the intent to exercise parental rights. It would create a federal crime punishable by up to 18 years in prison, fines, or both, and would also criminalize entering a surrogacy arrangement and then committing a sex offense between the use of interstate commerce and the child's birth while defining "surrogacy arrangement" and using the Sex Offender Registration and Notification Act definitions for "sex offender" and "sex offense".

Ban on surrogacy by sex offenders
This bill would make it a federal crime for a person who is a sex offender and required to register under SORNA to use interstate or foreign commerce to enter a surrogacy arrangement with the intent to be a parent. It would also criminalize anyone who uses interstate or foreign commerce to enter such a surrogacy arrangement and then commits a sex offense between that use and the child’s birth. A person convicted could be fined under title 18, imprisoned for up to 18 years, or both. The bill would define “sex offender” by referring to SORNA and define “surrogacy arrangement” as an agreement where a pregnant person agrees not to exercise parental rights and another person will take those rights.
