New federal gun-records database
This bill would require the ATF National Tracing Center to build an electronic, searchable database within 3 years. The database would cover all licensee records about importation, production, shipment, receipt, sale, or other disposition of firearms. It would be searchable by date, license number, and gun details like make, model, serial number, type, and caliber or gauge. The database would not be searchable by a person’s name or other personally identifiable information. Licensed dealers could give ATF electronic access and could voluntarily hand over old paper records after 10 years. The ATF tracing center could query the database only for three reasons: a bona fide law enforcement investigation, foreign intelligence (as defined in FISA), or a compliance inspection of a licensee who turned in paper records. The ATF could also access state registration or pawnbroker systems only if the State permits it.
