Make Housing Affordable and Defend Democracy Act

Sponsored By: Representative Gomez, Jimmy [D-CA-34]

In Committee

Summary

Housing tax incentives would create a wide set of tax credits to help first‑time buyers, spur starter‑home construction, convert old buildings to affordable units, and add a renter credit while rescinding $175.7 billion in unobligated prior‑reconciliation border and enforcement funds.

Show full summary
  • Families and first‑time buyers: Would create a First‑Time Homebuyer Credit of up to $25,000, or $50,000 for qualifying first‑generation buyers. It allows advance payments and includes a five‑year recapture rule and a basis reduction.
  • Builders, developers, and Tribes: Would create a Starter Home Construction Credit generally equal to 15% of qualified construction costs and an Affordable Housing Conversion Credit to convert nonresidential buildings with a $12.0 billion national allocation cap. State and tribal allocation systems and transferability rules apply.
  • Renters and low‑income households: Would create a renter tax credit tied to small‑area fair market rents with an optional monthly advance payment and a $50 million IRS outreach fund to promote enrollment.

*Would rescind $175.7 billion in unobligated prior‑reconciliation balances, reducing previously available border and enforcement funds by that amount.*

Bill Overview

Analyzed Economic Effects

6 provisions identified: 5 benefits, 1 costs, 0 mixed.

First-time homebuyer credit

This bill would create a refundable First-Time Homebuyer Credit for down payment and closing costs. You would be able to claim up to $25,000, or up to $50,000 if you qualify as a first‑generation homebuyer. Homes in FHFA high-cost areas would get an extra boost equal to 3.5% of the conforming-limit excess. The credit phases out by MAGI above $150,000 (single), $225,000 (head of household), and $300,000 (joint). The credit would be reduced if you get advance payments and could be recaptured if the home is not your main residence within five years.

Renter tax credit and advance

This bill would create a refundable Renter Tax Credit for rent above 30% of your adjusted gross income. The credit rate would be 100% if AGI ≤ $25,000, 75% for $25,001–$50,000, 50% for $50,001–$75,000, and 25% for $75,001–$100,000. Creditable rent would be capped at HUD small area fair market rent including utilities. You could elect monthly advance payments, and the IRS would get $50 million for outreach and program setup for five years.

Commercial-to-housing conversion credit

This bill would create an Affordable Housing Conversion Credit equal to 20% of qualified conversion expenditures for turning eligible commercial buildings into affordable rental housing. Conversions would generally need expenditures above the greater of 50% of the building's prior adjusted basis or $100,000 and largely incurred in the two years before placing the building in service. At least 20% of units must be rent‑restricted at or below 80% of area median income for 30 years. A $12 billion national cap would apply, with up to $3 billion more for distressed areas.

Extra LIHTC boost for very low-income units

This bill would let housing agencies treat the eligible basis for extremely low-income units as 150% of the normal basis when at least 20% of units serve households at or below the greater of 30% AMI or the poverty line. A housing credit agency must designate the boost is needed for project feasibility. That raises Low-Income Housing Tax Credit allocations for deeply affordable portions of projects receiving allocations after enactment.

Starter home builder credit

This bill would create a Starter Home Construction Credit for builders of small, lower-priced homes. The credit would be 15% of qualified labor and material costs, or 30% if the unit is sold to a first‑time homebuyer. Eligible units would be no larger than 1,200 square feet and sell for at most 80% of the area median home price. Each State would have an annual allocation ceiling equal to $30 times its population, and a taxpayer's property basis would be reduced by the credit.

Rescind unobligated border funds

This bill would permanently rescind $175.66 billion in previously appropriated but unobligated border and immigration funds. Major line items named include $46.55 billion for border infrastructure and wall systems, $45.00 billion for detention capacity, $29.85 billion for ICE hiring and training, and other DHS and prison items. The rescission would take effect on enactment and would repeal the cited sections of the prior reconciliation law.
