To modify the procedures for investigating claims of evasion of antidumping and countervailing duty orders.
Sponsored By: Representative Kelly, Mike [R-PA-16]
Introduced
Summary
Creates a new self-initiation authority letting the Commissioner open investigations when there is information that reasonably suggests evasion of antidumping and countervailing duty orders. It would also require payment of all liquidated duties, charges, and exactions before a party may seek judicial review of an evasion finding.

New customs evasion rules for importers
If enacted, businesses that import, export, broker, or make goods covered by antidumping or countervailing duty orders would face two changes. The Customs Commissioner would be able to start an evasion investigation on the agency's own if the Commissioner has information reasonably suggesting goods were entered by evasion. Any self-started investigation would follow the same terms and conditions that apply to formal allegations and referrals. Also, a person found to have entered covered goods through evasion would be able to seek judicial review only after all liquidated duties, charges, and exactions have been paid at the time the judicial review is sought.
