Introduced

Summary

Bars routine DHS arrests at immigration court facilities and during scheduled check-ins. Show full summary
  • Immigrants and families: People attending or arriving at or leaving immigration hearings would be protected from arrest or detention while their cases remain unresolved, including during appeals and motions, unless a judicial warrant or an imminent threat applies.
  • People checking in with DHS: The bill would bar arrests during scheduled DHS check-ins unless a senior field management official provides written authorization that states the legal basis, and the arrest is reported to the DHS Inspector General within 30 days.
  • Oversight and transparency: The DHS Inspector General would be required to produce a report starting one year after enactment and then annually. The report must list attempted and completed arrests, the legal basis for each, the immigration case posture of those arrested, and steps the Secretary takes to ensure compliance.

Limits on DHS arrests for immigrants

If enacted, this bill would bar DHS officers or agents from arresting or detaining noncitizens who are physically at EOIR immigration court facilities to attend or take part in hearings. The bar would cover arriving, leaving, and attending scheduled DHS check‑ins tied to immigration proceedings. Exceptions would allow arrests under a judicial warrant, actions to prevent imminent violence or a specific, articulable threat to life, public safety, or national security, and arrests at check‑ins with written supervisory approval from at least the senior field management level. If a supervisor approves an arrest at a check‑in, DHS would have to report it to the DHS Inspector General within 30 days and include it in the annual IG compliance report. The protections would apply to people whose immigration cases are not final, including during appeals, motions to reopen or reconsider, and other challenges to removal.
