Military in Law Enforcement Accountability Act
Sponsored By: Representative Liccardo, Sam T. [D-CA-16]
Introduced
Summary
Limits Department of Defense support for civilian law enforcement. This bill would create a new statutory process that forces advance justification and oversight before DOD or federal law enforcement personnel assist civilian police, sets a short cap on mission length, bans most dual service, and creates a private right to sue.
Show full summary
- Service members and dual-role workers: Prohibits most people from serving in the Department of Defense and in civilian law enforcement at the same time. Certain reserve members may keep civilian police jobs but must recuse if activated for duty.
- Local police departments and cities: Requires detailed pre-approval notices with budget, timeline and milestones, funding and sustainment plans, outcome metrics, and records of support from the prior 3 fiscal years. DOD support may not continue past 30 days unless Congress approves a longer period.
- Individuals, states, and local governments: Allows anyone aggrieved by a violation to sue the federal government in federal court and seek injunctions or damages.

Bill Overview
Analyzed Economic Effects
3 provisions identified: 1 benefits, 1 costs, 1 mixed.
Right to sue for violations
If enacted, any person, State, or local government harmed by a violation of this bill could sue the federal government or its officers in federal court. Courts could order the government to stop unlawful acts and award damages or other equitable relief.
Ban on dual military and police jobs
If enacted, people serving in any Department of Defense role would not be allowed to also serve in civilian law enforcement at the same time. Members of certain reserve components could keep their civilian police jobs, but they would have to officially stop those police duties if called or ordered to active duty.
Limits and rules for military help
If enacted, the Department of Defense would need to send Congress a written notice before using certain authorities to help civilian law enforcement. The notice would list the recipient, budget, timeline with milestones, funding sources and sustainment plans, goals with measurable metrics, and the help given in the prior three fiscal years. DoD could not provide such support for more than 30 days without a special joint resolution from Congress. The bill would also remove a phrase limiting one assistance rule to civil disturbances, which could let military support federal authorities in more situations.
