Noncontiguous Shipping Reasonable Rate Act of 2024
Sponsored By: Representative Case, Ed [D-HI-1]
In Committee
Summary
Benchmarks domestic noncontiguous ocean freight rates to international indexes with a 10% tolerance. This bill would amend 49 U.S.C. 13701(d) to define a “reasonable” rate for noncontiguous shipping as a rate within 10 percent of a comparable international ocean rate index that the Federal Maritime Commission recognizes. It names the measure the Noncontiguous Shipping Reasonable Rate Act of 2024 and establishes that FMC-recognized international rate indices serve as the comparator standard for reasonableness.

New benchmark for Alaska, Hawaii, and territories shipping rates
If enacted, ocean shipping rates to Alaska, Hawaii, Puerto Rico, and other U.S. territories would be judged against an index. A rate would be considered reasonable only if it is within 10 percent of a comparable international rate the Federal Maritime Commission recognizes. This would mainly affect shippers and customers in off‑mainland trade routes. The bill does not set an effective date or new enforcement tools.
