Restricting First Use of Nuclear Weapons Act of 2025
Sponsored By: Representative Lieu, Ted [D-CA-36]
Introduced
Summary
Blocks use of federal funds for any U.S. first‑use nuclear strike unless Congress declares war and expressly authorizes that strike. The bill ties any first‑use nuclear action to a congressional declaration and requires high‑level confirmation that the United States, its territories, or its allies have been struck before funds can be used for a response as defined by the Arms Export Control Act.

Limit presidential first-use of nuclear weapons
If enacted, the bill would say the United States should not launch a first-use nuclear strike unless Congress declares war and expressly authorizes it. It would define a "first-use nuclear strike" as a nuclear attack carried out without the Secretary of Defense and the Chairman of the Joint Chiefs first confirming to the President that the U.S., its territories, or its allies were already struck (see 22 U.S.C. 2753(b)(2)). It would bar federal agencies from obligating or spending money to carry out a first-use strike unless Congress has declared war and authorized that strike. The policy would take effect upon enactment and the text provided does not create a new criminal penalty.
