To provide for the designation of Burma for temporary protected status.

Sponsored By: Representative Huizenga, Bill [R-MI-4]

Introduced

Summary

Designates Burma for temporary protected status (TPS). This bill would treat Burma as designated under section 244(b)(1)(C) of the Immigration and Nationality Act and set an 18-month TPS period beginning November 25, 2025. Nationals of Burma could qualify if they have been continuously physically present in the United States since the date of enactment, are admissible and not otherwise ineligible, and register for TPS as the Secretary of Homeland Security establishes. The Secretary must give prior consent for brief emergency travel abroad and will treat returning beneficiaries like other TPS returnees.

Temporary protected status for Burma nationals

If enacted, this bill would designate Burma for Temporary Protected Status (TPS) for an 18-month period starting November 25, 2025. Nationals of Burma who have been continuously physically present in the United States since the date this Act is enacted, who are admissible, and who register as the Secretary of Homeland Security requires would be deemed to meet the TPS presence rule and be eligible for TPS during that period. TPS would protect eligible people from removal and could let them apply for work authorization. The Secretary would have to give prior consent for brief emergency or extenuating trips abroad if the person shows such circumstances; returning with that consent would preserve their TPS return rights.
