Introduced

Summary

Tax-free gain for seniors selling to first-time homebuyers. The exclusion would apply only to sales of $500,000 or less and would require the buyer to sign a statement under penalty of perjury at closing that they are a first-time homebuyer. It would apply to sales after December 31, 2026 and would not apply to sales after December 31, 2031. Section 121 would not apply to sales covered by section 121A.

Tax-free home sale for seniors

This bill would let you exclude gain from the sale of real property from your taxable income if you (or your spouse on a joint return) are age 65 or older on the sale date. The buyer must be a first-time homebuyer who will use the property as their principal residence and must sign a closing statement under penalty of perjury saying so. The sale price must be $500,000 or less. The rule would apply to sales after December 31, 2026, and it would end for sales after December 31, 2031. This exclusion would replace the existing home-sale exclusion for those qualifying sales.
