Bill Overview

Analyzed Economic Effects

2 provisions identified: 0 benefits, 2 costs, 0 mixed.

Ban on federal jobs for violent offenders

If enacted, this would bar any individual finally convicted of a crime of violence from accepting or holding any federal civil service job. If a federal civil servant's conviction becomes final while they hold the job, the person would have to be removed. The bill uses the definition of "crime of violence" in 18 U.S.C. §16 but excludes offenses described in subsection (b) of that section. "Final conviction" is defined as a conviction that was not appealed and is no longer appealable, or one where the appeals process is complete. This provision would take effect on enactment.

No federal contracts with violent offenders

If enacted, this would bar the federal government from entering into a contract with any person finally convicted of a crime of violence, or with any company where that person holds a covered position. A "covered position" would include providing goods or services under the contract, serving as an officer or director (including on the board), or holding a controlling ownership interest. Agency contracts would be required to include a clause barring covered individuals from working on the contract. The Director of OMB could grant a waiver if ending the contract or banning the person would impose a unique or undue burden on the government. The ban would apply to contracts entered before, on, or after enactment, and the Federal Acquisition Regulation would be revised within six months of enactment to implement these rules.
