DHS Use of Force Oversight Act
Sponsored By: Representative Ramirez, Delia C. [D-IL-3]
In Committee
Summary
Department-wide use-of-force policy for Department of Homeland Security law enforcement that emphasizes safer tactics and bans chokeholds and carotid restraints.
Show full summary
- DHS officers and agents must use force only when it is objectively reasonable, and the department must require initial and recurrent training covering the full range of tactics and de-escalation, plus a subject-matter-expert and a review council in each component to analyze incidents and improve practices.
- The public and families gain more transparency. DHS components must publish consistent incident data every six months on the department website, showing injuries or deaths, use of deadly force, less-lethal devices, canine deployments, kinetic-impact tactics, and disabling fire against vessels or aircraft, while protecting privacy.
- Accountability increases through quick and public response and oversight. The Secretary must brief relevant congressional committees within 24 hours after any incident resulting in hospitalization or death, and the Department's Inspector General will review compliance with the policy and training requirements.

DHS use of force reporting
This bill would require DHS components to collect the same use-of-force data and publish a public report every six months on incidents from the prior six months. Reports would cover incidents that caused injury or death, involved deadly force or firearm discharge, used less-lethal devices or canines, used kinetic-impact tactics, or included disabling fire against a vessel or aircraft. The Secretary would have to brief relevant congressional committees and inform the public within 24 hours of any incident causing hospitalization or death. The DHS Inspector General would continually review whether components follow the new policy and reporting rules, and published data would protect privacy.
New DHS use of force policy
This bill would require the Secretary of Homeland Security to adopt one Department-wide use-of-force policy for DHS officers and agents. The policy would say force must be objectively reasonable considering the totality of the circumstances and that deescalation is preferred. When feasible, officers would need to identify themselves and give a verbal warning before using force. The policy would ban chokeholds and carotid restraints on non-compliant people and require initial and regular training, a designated subject-matter expert in each DHS component, and a use-of-force review council to study incidents and update training and tactics.
