Realigning Mobile Phone Biometrics for American Privacy Protection Act

Sponsored By: Representative Thompson, Bennie G. [D-MS-2]

In Committee

Summary

Limits DHS use of mobile biometric apps to ID checks at U.S. ports of entry. The bill would sharply restrict how the Department of Homeland Security uses and shares the Mobile Fortify and Mobile Identify mobile applications and any successor apps, and it would force deletion of certain biometric images to protect privacy.

  • Families and U.S. citizens: Requires immediate destruction of any image, photograph, or fingerprint of a U.S. citizen already captured by these apps wherever stored. For images captured for identification at ports of entry the bill would require destruction no later than 12 hours after capture, with limited exceptions noted in the text.
  • DHS and its components: Would require removal of these apps from DHS information technology except as needed for port-of-entry identification and would let DHS remotely render the apps inoperable on non-DHS devices.
  • Other governments and agencies: Prohibits DHS from sharing the Mobile Fortify, Mobile Identify, or successor apps with any other Federal, state, local, Tribal, or territorial agency.
  • Technology and data scope: The restrictions apply to both current and successor applications and to any imagery or biometric data those apps obtain.

Limits DHS mobile biometrics use

This bill would require DHS to issue standards within 30 days on Mobile Fortify, Mobile Identify, and successor apps. DHS would only be able to use those apps to identify people at U.S. ports of entry. The bill would bar DHS from sharing the apps with other Federal, State, local, Tribal, or territorial agencies. DHS would have to remove the apps from its systems except where needed at ports of entry, and remotely disable copies on non‑DHS devices. Images, photos, or fingerprints of United States citizens captured by these apps before the standards are issued would have to be destroyed immediately. Biometric images captured at ports of entry would have to be deleted no later than 12 hours after capture.
