Humanitarian Standards for Individuals in ICE and CBP Custody Act

Sponsored By: Representative Ruiz, Raul [D-CA-25]

In Committee

Summary

This bill would set federal, health-focused humanitarian standards for people held by ICE and CBP. It prioritizes timely medical screening, basic hygiene and nutrition, safe shelter, and stepped-up oversight and staff training for custody facilities.

Show full summary
  • People in custody and their families would get an initial in-person health screening within 12 hours, or within 6 hours for high-priority cases. Screenings must cover vitals, glucose checks for suspected diabetics, weight for children under 12, medication management, and access to psychological support.
  • Facilities would have to provide at least 1 gallon of drinking water per person per day and three meals totaling not less than 2,000 calories for people 12 and older. They must also offer private toilets and showers, diaper changing, accessible housing for people with disabilities, temperature-appropriate bedding and clothing, and space for quiet sleep.
  • The Department of Homeland Security would arrange training for ICE and CBP staff on humanitarian care and child abuse indicators, require contractor compliance, and allow unannounced inspections by the DHS Inspector General. Video monitoring must be preserved for 90 days and the bill would require planning documents to Congress within 60 days and full implementation within 6 months of enactment.

Bill Overview

Analyzed Economic Effects

5 provisions identified: 4 benefits, 0 costs, 1 mixed.

Faster medical care for detainees

If enacted, anyone detained by ICE or CBP would get an in‑person medical screening by a licensed provider. Standard checks would occur within 12 hours and high‑priority people within 6 hours. Abnormal vital signs would trigger an emergency consult and a recheck within 24 hours. The bill would require medication continuity, basic psychological help, language interpretation, and medical records on release.

Basic living standards in custody

If enacted, detention sites would have minimum standards for food, water, hygiene, and shelter. People 12 and older would get at least 2,000 calories daily and everyone would receive three meals per day. Facilities would provide at least 1 gallon of drinking water per person each day, diapers, private showers daily, and toilets at set ratios. Housing rules would keep gender separation, disability access, temperatures at 68–74°F, at least 1 hour outside after 48 hours, and video monitoring records for 90 days.

Coverage rules and detention limits

If enacted, the bill would define who counts as a child and which ICE and CBP locations the rules cover. It would make clear nothing in the Act allows detention longer than 72 hours. The bill would also preserve existing DHS sexual‑abuse prevention and hiring rules, including current background checks and employment authorities. These clauses clarify coverage and keep existing protections in place.

Stronger inspections and reporting

If enacted, the DHS Inspector General would do unannounced checks of ports, border stations, detention sites, and contractors and report results to Congress. DHS would publish quarterly, aggregate data on sexual‑abuse complaints starting within 90 days of enactment. Members of Congress could not be denied entry to any ICE or CBP facility. The Secretary would also submit a detailed plan to Congress within 60 days and implement the rules within six months.

Training and contractor surge support

If enacted, DHS would require contractors to follow the Act's care and safety rules and would make MOUs and contracts for medical, public‑health, social‑work, and transport surge needs. ICE and CBP staff in short‑term custody would get mandatory training on humanitarian response, signs of illness, spotting child sexual exploitation, and how to report missing children. These steps would boost care and capacity but add compliance and contracting obligations for vendors and staff.
