Show full summary
  • Drug developers: Sponsors could get contracts up to 10 years long with annual payments set between $75 million and $300 million, reduced by net U.S. sales. Applications must follow a Secretary-led scoring framework.
  • Health care providers and patients: Grants would fund antimicrobial stewardship and outpatient pilot programs, prioritizing rural, Tribal-serving, safety-net, and critical access settings.
  • Public health systems: The Centers for Disease Control and Prevention would expand resistance and use data collection across hospitals, nursing homes, outpatient care, and other settings and publish results at least annually beginning two years after enactment.

*This bill would authorize $6.0 billion for FY2026 as emergency funding, increasing federal outlays and remaining available until expended.*

Bill Overview

Analyzed Economic Effects

5 provisions identified: 4 benefits, 1 costs, 0 mixed.

Big grants for antibiotic stewardship

This bill would create two grant programs to strengthen antibiotic stewardship. CDC would set up a Health Facility Grant Program within one year and an outpatient stewardship pilot within two years. The bill would authorize and appropriate $6 billion for fiscal year 2026, to remain available until spent, and require a report to Congress on the outpatient pilot within five years. Up to 6.5 percent of the money may be used for surveillance activities.

Nationwide antibiotic resistance data

This bill would direct CDC to collect much more national data on antibiotic and antifungal resistance and use. Data would include infection types, patient details, costs, deaths, resistance trends, and diagnostic testing. CDC would use hospital, lab, and electronic medication records and would make the data public starting two years after enactment and at least once a year thereafter. The agency would also look at ways to provide data in near real time.

Government contracts to guarantee antibiotics

This bill would create a contract program to pay drug sponsors for keeping key new antibiotics and antifungals available in the U.S. The Secretary must set a scoring method within 270 days, and drug sponsors must apply within two years of FDA approval. Contracts would pay annual amounts between $75 million and $300 million per product (each adjusted by CPI‑U), starting within 180 days after approval and reduced by net U.S. sales. Contracts could last up to 10 years and payments may stop for market withdrawal or serious contract breaches.

Drugmaker supply and reporting rules

This bill would require drug sponsors who enter these contracts to meet many new obligations starting 30 days after their first payment and for the contract term. Sponsors would have to keep the drug sold in the U.S., make enough for patient needs and susceptibility testing, submit shortage response plans within 30 days of an FDA shortage finding, track and publicly report resistance data, provide stewardship and education plans, register products abroad on request, and follow environmental manufacturing standards.

Advisory group for critical antibiotics

This bill would create a 15‑member Critical Need Antimicrobial Advisory Group within 60 days after enactment. Members would include infectious disease doctors, experts in resistance and drug development, patient advocates, and others. The Chair would be non‑voting. Members could not be paid by commercial antimicrobial developers and must recuse themselves for direct financial conflicts.
