Form 5500 Filing Simplification Act

Sponsored By: Representative Grothman, Glenn [R-WI-6]

In Committee

Summary

Standardize Form 5500 filing deadlines and modernize how retirement plans submit and sign annual reports by allowing electronic filings and a later, fixed deadline.

Show full summary
  • Plan administrators and sponsors would file Form 5500 and furnish required information to participants and certain employers by 15 days after the end of the 9th calendar month following a plan year. The Secretary could grant extra time if a plan is affected by a disaster or fire.
  • Participants and certain employers would receive plan reports and notices on that later, uniform schedule, which could delay when they see annual plan information.
  • The Treasury Department, the Department of Labor, and the Pension Benefit Guaranty Corporation would align regulations and issue implementing guidance. The bill would permit electronic signatures and submissions and includes a good-faith compliance rule until agencies update systems. It would apply to plan years ending on or after enactment.

Bill Overview

Analyzed Economic Effects

2 provisions identified: 2 benefits, 0 costs, 0 mixed.

Electronic signatures for Form 5500

If enacted, the bill would let plans sign and submit Form 5500 filings and related ERISA reports electronically. The Treasury, Labor Department, and PBGC would be directed to update regulations and guidance to allow electronic signatures and electronic submission of any required accompanying information. Plans that use the new electronic-signature framework in good faith would be treated as meeting the rule until agencies finish their updates. This change would apply to plan years ending on or after the date of enactment.

Later Form 5500 filing deadline

If enacted, the bill would change annual Form 5500 and ERISA report deadlines. Filings and the required participant or employer notices would be due no later than the date that is 15 days after the end of the 9th calendar month that begins after the close of the plan year. The Secretary could allow a later filing if the plan or related persons were affected by a disaster, fire, or an action described in IRC section 7508A(b). The change would apply to plan years ending on or after the date of enactment.
