Sponsored By: Representative Nehls, Troy E. [R-TX-22]
In Committee
Summary
Ban on air transport of adult roosters. This bill would bar air carriers from knowingly transporting an adult rooster in interstate or foreign air transportation unless the shipment starts or ends at a commercial farm and serves a legitimate agricultural purpose. A commercial farm must show $350,000 or more in annual gross cash farm income as classified by the USDA Economic Research Service and provide documentation to the carrier before transport. Enforcement would be by the Secretary of Transportation in coordination with the Federal Aviation Administration, violations would carry civil penalties, states could adopt stricter rules, and the rule would take effect 180 days after enactment.

New air rules for rooster shipments
This bill would bar air carriers from knowingly transporting adult roosters in interstate or foreign flights. It would allow an exemption only for shipments to or from commercial farms with $350,000 or more in annual gross cash farm income. Anyone claiming the exemption would have to give the carrier paperwork, such as financial records or attestations consistent with USDA Economic Research Service guidelines, before transport. The bill defines an adult rooster as a male chicken at least 6 months old. The Secretary of Transportation, in coordination with the FAA, would enforce the rule and could issue civil penalties under chapter 463. States could keep or adopt stricter rules. The rule would start 180 days after enactment.
