New FMCSA tool to spot bad carriers
This bill would require FMCSA to build, test, and start an automated tool within 1 year to flag "chameleon carrier" DOT number applications. The tool would look for continuity across names, owners, addresses, equipment, drivers, or insurance lapses and would compile evidence for registration staff. FMCSA staff would make final registration decisions. People denied because of a flag would get a notice listing flagged factors, have 30 days to correct the application, and get a redetermination within 30 days after correction. FMCSA would enter data‑sharing agreements with Federal and state agencies, brief Congress within 30 days of enactment, and the DOT Inspector General would audit tool effectiveness and report to Congress within 2 years after the tool starts, including counts of flagged and rejected applications and crash-related outcomes.
Clear definition of "chameleon carrier"
This bill would define "chameleon carrier" to include motor carriers, intermodal equipment providers, brokers, freight forwarders, and affiliated people who try to operate under a new name or affiliated entity to avoid FMCSA orders, rules, penalties, enforcement, or higher insurance. The definition would also cover using a new identity to get insurance after cancellation or to hide negative safety history. This definition would take effect upon enactment and would guide FMCSA detection and enforcement.
