Plastic Pellet Free Waters Act

Sponsored By: Representative Levin, Mike [D-CA-49]

In Committee

Summary

Bans discharge of plastic pellets and other pre-production plastic materials into U.S. waters. This bill would require the EPA to issue a final rule within 60 days that prohibits those discharges from facilities covered by 40 CFR parts 414 and 463 and from any point source that makes, uses, packages, or transports these materials.

Show full summary
  • Facilities regulated under 40 CFR parts 414 and 463 and any point source involved in making, using, packaging, or transporting plastic pellets would face a federal prohibition on discharging those materials and would have those limits written into their permits.
  • EPA and state-delegated permitting programs must include the prohibition in all wastewater, stormwater, and other permits issued under section 402 of the Federal Water Pollution Control Act.
  • The prohibition must also be reflected in standards of performance under section 312(p) and the rule must rely on regulatory provisions “as in effect on the date of enactment” to define its scope.

Ban on plastic pellet discharges

If enacted, the bill would require the EPA Administrator to issue a final rule within 60 days of enactment. The rule would ban discharges of plastic pellets and other pre-production plastic materials into wastewater and runoff from facilities regulated under 40 C.F.R. parts 414 and 463 and from any point source that makes, uses, packages, or transports those materials. The EPA would have to ensure section 402 permits and section 312(p) performance standards reflect the ban. If passed, this could reduce pellet pollution in waterways but would require facilities and permitting programs to change permits and practices to comply.
