CARBON Act
Sponsored By: Representative Onder, Robert F. [R-MO-3]
Introduced
Summary
Would exclude carbon dioxide, methane, and nitrous oxide from the Clean Air Act's definition of "air pollutant." The CARBON Act would amend Section 302(g) of the Clean Air Act so those three greenhouse gases are not treated as air pollutants under the Act. That change would narrow the Act's regulatory reach over emissions of those gases and is framed to curtail federal agency activity tied to net-zero regulatory efforts.

Limits EPA reach on greenhouse gases
If enacted, the bill would remove carbon dioxide, methane, and nitrous oxide from the Clean Air Act's definition of "air pollutant." That would limit EPA and other agencies from using many Clean Air Act rules against sources that emit only those gases. Facilities that mainly emit these gases would likely face fewer regulatory requirements and lower compliance costs. Communities could get less protection against these emissions and climate-related harms. The change would take effect upon enactment.
